This Intellectual Property Rights (IPR) policy is formulated to guide faculty, staff, students, and external stakeholders in understanding the practices, rules and regulations concerning intellectual property rights.

Policy
Preamble:
K.L.N. College of Engineering (An Autonomous Institution) is dedicated to promoting, protecting, managing, and commercializing intellectual property in alignment with its primary objectives of teaching, research, and community service since 1996. The college supports the commercialization and exploitation of intellectual property while recognizing traditional academic values and expectations through the Quality Circle Industrial Relations (QC-IR).
Scope:
This policy covers all intellectual property rights arising from the creative and innovative work of faculty, staff, students, research scholars, and external collaborators, regardless of eligibility for registration. Intellectual property includes patents, designs, copyright, know-how, and undisclosed information resulting from academic social and industrial research.
- I. Intellectual Property (IP): All results, inventions, ideas, improvements, discoveries, designs and copyrightable works generated by faculty, staff, students, and other employees of the college are IP protectable.
- II. Intellectual Property Rights (IPR): Rights derived from intellectual property, such as patents, registered designs, and copyrights.
- III. Background Information: Technical information and know-how owned are controlled by partners of a collaborative research program. A mutual consent has to be given, before its commencement of the date of activation of collaboration.

- V. Foreground Intellectual Property: Intellectual property generated during a collaborative research program.
Ownership of Intellectual Property:
The Inventor/ applicant will specify the individuals who are directly contributed in the intellectual inputs as inventors or creators in all applications filed under intellectual property rights through KLNCE. If any dispute arises, the committee constituted by the college IPR cell will disclose it.
I. Institute-Supported Research: All rights in intellectual property resulting from investigations using college resources shall be the absolute property of the college and the inventors specified by the institution.
II. Sponsored Research:
a) Intellectual property rights arising from entirely funded research projects shall be jointly registered in the name of the college and the sponsoring agency on mutual consent from sponsoring agency and college
b) Ownership and sharing of intellectual property rights will be decided through mutual consultations and agreements if the project is partially funded or if it has multiple sponsors.
c) Industry-sponsored research may have various ownership arrangements, depending on mutual consent.
III. Joint Research: Intellectual property resulting from joint research will be owned jointly, with filing and maintenance costs shared according to an mutually agreed consent.
Technology Transfer:
I. The college shall take necessary steps for commercial exploitation of intellectual property to the fullest extent possible, marketing under agreements involving technology transfer, licensing, and revenue-sharing models among them.
II. The college will identify potential licensees for IP it owns outright, offering joint IP exploitation to collaborators before proceeding independently.
Revenue Sharing:
The revenue from commercial exploitation of IP (technology transfer fee and royalties) shall be shared between the inventor(s) and the college, with the current ratio set at 60:40.(ie: 60% to inventors and 40% to college) If the college reassigns IP rights to inventors, they must reimburse all associated costs.
Infringements, Damages, Liability, and Indemnity Insurance:
The college shall seek indemnity in contracts with licensees, and agreements will include indemnity clauses with licensee(s) when transferring technology or copyrighted material.
Conflict of Interest:
Inventors must disclose any conflict of interest or potential conflict, particularly when having a stake in a licensee or potential licensee. Approval from the IPR Cell is required for disclosing the conflict.
Dispute Resolution:
Disputes regarding the implementation of the IP policy shall be resolved through an appeal to the Head of the Institute and its committee constituted by the Management with the committee’s decision being final and binding.
Applicants Norms:
This policy is a part of the conditions of enrollment for all employees and students. All potential creators involved in sponsored research projects or using college-sponsored resources must adhere to this norms and regulations.
Right to Regulate Policy:
The IPR Cell is responsible for interpreting and recommending changes to the policy as and when needed as per Central Govt. / State Govt. norms. The Principal along with a committee will consider such changes or recommendations. The policy will be reviewed every three years or earlier if major changes occur nationally from Government authority such as affiliating university, AICTE and UGC.
Legal Jurisdiction:
All agreements and disputes arising from them will be subject to the legal jurisdiction of the Court of Ad judicature at Madurai, governed by the appropriate laws of India.
